What is an Independent Children’s Lawyer (ICL)?

An ICL is appointed by the Family Court to make sure that a child’s needs and wellbeing are at the heart of every decision. They are not on the side of either parent or carer—their focus is solely on what is best for the child.

In this role, the ICL:

Keeps the child’s best interests front and centre

Guiding the court to make choices that protect their safety, stability, and happiness.

Gathers a complete picture

By speaking with people who know and care for the child, such as teachers, doctors, and counsellors.

Arranges expert assessments

Like family or psychological reports, when more insight is needed.

Provides clear recommendations

Based on evidence and what will best support the child’s future.

Helps the child’s voice be heard

In a way that is safe, respectful, and appropriate for their age.

The ICL’s role is to be a steady, impartial guide for the court—ensuring that every decision is made with compassion, fairness, and the child’s long-term wellbeing in mind.
